Welcome to Boomirang. By accessing or using the Boomirang platform at boomirang.com (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our service.

These Terms constitute a legally binding agreement between you and Boomirang Pty Ltd ("Boomirang", "we", "us", "our"). If you do not agree to these Terms, you must not use the Platform.

1. About Boomirang

Boomirang is an Australian streaming platform that distributes original Australian films, television series, pilots, and documentaries. The Platform is operated by Boomirang Pty Ltd, an Australian company.

2. Eligibility

To create an account and use Boomirang, you must:

• Be at least 13 years of age. If you are under 18, you must have parental or guardian consent.
• Have the legal capacity to enter into a binding agreement in your jurisdiction.
• Not be barred from receiving services under applicable law.
• Provide accurate and truthful information during registration.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.

• Not transfer your account to any other person without our written consent.

• Engage in unauthorised scraping, crawling, or data mining of the Platform.
• Attempt to gain unauthorised access to any portion of the Platform or its related systems.
• Harass, abuse, or harm another person or group.
• Use the Platform for any commercial purpose without our express written consent.
• Circumvent, disable, or interfere with security-related features of the Platform.

5. Intellectual Property

All content on the Platform — including but not limited to films, text, graphics, logos, icons, images, audio clips, and software — is the property of Boomirang or its content licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and view content on the Platform for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Platform without our prior written consent.

6. Content Uploaded by Users and Filmmakers

Filmmakers who have been granted Creator access may upload content to the Platform. By uploading content, you:

• Represent that you own or have the necessary rights to all content uploaded.
• Grant Boomirang a worldwide, non-exclusive, royalty-free licence to host, display, and distribute your content on the Platform.
• Agree that your content complies with our Content Policy.
• Accept full responsibility for any claims arising from your content.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers

The Platform and all content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any content on the Platform.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Boomirang Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) or other non-excludable statutory rights.

10. Indemnification

You agree to indemnify, defend, and hold harmless Boomirang Pty Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your infringement of any rights of another.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the effective date. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes.
